She sure can if she is in control of his estate.

You really need to talk to a lawyer because it is going to depend on your specific situation. Did he know that was a possibility before he died or specify anything about that situation in his will? Most likely, anything that was not specifically left to a child would go to his spouse so the kids would not have gotten anything unless she wanted to give it to them anyway. However, if he had stated in his will that he wanted something else done with any possible money awarded after his death, and she turned down the money to intentionally prevent that from happening, she could have a legal problem on her hands.
